What is Probate?
Probate is the legal process that takes place after a death. First, wills are proven to be valid in a usually very routine court proceeding. Identifying and inventorying the deceased person's estate, having assets appraised, paying any outstanding debts and taxes, and distributing the remaining estate as per the will is also part of the process.
A process called administration is used when wills are not available. Requesting a grant of administration to prevent the assets being distributed in accordance with State laws, requires a significant amount of documentation and paperwork.
